  • The Manager's Duties

    • To collect and bank Service Contributions and levies.
    • To keep proper books of account and prepare an annual financial statement of the Owners Corporation.
    • To prepare and submit to the Annual General Meeting a report of the Owners Corporation activities and budget to assist owners in assessing expenses and setting the amount of contributions for the coming year.
    • To convene and attend Annual General Meeting and to record and distribute minutes of the meeting within the prescribed time.
    • To maintain any insurance policies required by the Regulations and to process member's claims under these policies in return for any reasonable fee paid by the insurance company or broker.
    • To inspect the property at least once a year for the purpose of familiarisation with the general appearance, but not for the purpose of assessment of maintenance requirements or inspection of works carried out by tradespersons on behalf of the Owners Corporation.
    • To pay from Owners Corporation funds day to day expenses incurred by the Owners Corporation.
    • To obtain quotations for and arrange day to day maintenance of the common property, at the request of the Owners Corporation.
    • To prepare Owners Corporation certificates and to answer requisitions on title for the sale of lots affected by the Owners Corporation and to retain the fees prescribed by the Regulations.
    • To keep, affix and witness the affixing of the common seal of the Owners Corporation to documents as and where required.
    • To generally deal with the secretarial requirements of the Owners Corporation including inward and outward correspondence and as requested to advise on matters of procedure and management.

    The Owner's Duties

    • Owners must give tenants a copy of the rules of the Owners Corporation at the commencement of the tenancy and a copy of any new rules as soon as possible.
    • Owners must maintain their lot and any services connected to their lot in a state of good and serviceable repair.
    • Owners must advise the Owners Corporation manager within one month of purchase of their name, mailing address and telephone number and any changes to them as soon as possible and if the property is tenanted, owners must advise the name of the tenant and any rental agents name, address and telephone number.
    • Owners must not use or neglect or permit the common properties use or neglect in a manner that is likely to cause damage or deterioration.
    • Owners must pay any Service Contributions or levies imposed by the Owners Corporation by the due date.
    • Owners must obey and ensure their tenants obey the rules of the Owners Corporation.
    • Owners must provide access to their lot to allow the Owners Corporation to inspect, maintain or replace any component for which the Owners Corporation is responsible or for which the owner failed to undertake the works within the specified time.

    Owner Obligations

    • In addition to legal obligations an owner also has the moral obligation as a member of the Owners Corporation to ensure that the common property is maintained.
    • An owner should regularly inspect the common property and report to the committee via the manager or at a general meeting any items of maintenance requiring attention by the Owners Corporation.
    • An owner should monitor the progress of items of repairs and maintenance and upon completion report any defects in writing as soon as practical.
    • An owner should inspect and authorise payment of accounts for major works when requested.
    • An owner should complete an insurance claim form and liaise with loss adjusters where a claim affects an individual lot.
    • An owner should attend meetings to comment and vote on Owners Corporation issues including budgets and proposed maintenance items.
    • An owner should provide written support of any complaint made against another owner or tenant and if required, act as witness at legal proceedings brought against such owner or tenant.

    Supplementary Management Services
    The following additional management services are available at a negotiated fee:

    • Supervise or attend any legal proceedings or hearings affecting the Owners Corporation on behalf of the Owners Corporation, or as a witness.
    • Provide financial statements in addition to the annual statements.
    • Arrange for and on behalf of the Owners Corporation any improvements, major maintenance, major repair and replacement of the common property and personal property vested in the Owners Corporation including any work the need for which arises as a result of a major disruption to the services.
    • Liaise with Accountants, Auditors, Architects, Engineers, Builders, Loss Adjusters and other professionals in relation to work or matters affecting the Owners Corporation, or substantial insurance claims.
    • Keep wage, BAS, taxation and other related records required to be kept by the Owners Corporation including any obligation which the Owners Corporation may have for income tax purposes including PAYE obligations, Prescribed Payments System obligations and any obligations under the Superannuation Guarantee Legislation or Accident Compensation Act and to make remittances or lodge such prescribed forms with the relevant authorities as may be required.
    • Make applications and submissions to government or related bodies or tribunals.
    • Rectify deficiencies in the books and records of the Owners Corporation, existing before appointment of Melbourne Body Corporate Management.
